By accessing or using our website at www.motionvault.net (the "Site"), you agree to comply with and be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using our services. If you do not agree to these Terms, please do not access or use our Site.
These Terms are between you and MOTIONVAULT. They should be read together with our License Terms at www.motionvault.net/license and our Privacy Policy at www.motionvault.net/privacy-policy. If there is a conflict about template usage rights, the License Terms control for that subject.
MOTIONVAULT is a premium template marketplace offering high-quality video animation templates and tools, available through subscription plans and one-time pack purchases, for video editors, content creators, marketers, and businesses. Our intuitive templates and time-saving tools streamline your workflow, enabling you to create stunning videos quickly and efficiently.
By accessing www.motionvault.net and using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are accessing the website on behalf of a company or legal entity, you represent that you have the authority to bind that entity to these Terms.
If you are under 16 years old, you may only use www.motionvault.net with the consent and supervision of a parent or legal guardian.
MOTIONVAULT offers subscription plans (Monthly, Yearly) for access to our video template library on a recurring payment basis.
A valid subscription is required to download library content, except free templates and packs you have purchased (see Section 3.1). You can browse the available video templates without an account, but you must sign up to download or use any templates. Users can upgrade or downgrade their subscription plans at any time through their account settings. Changes take effect at the start of the next billing cycle.
For purposes of these Terms and the License Terms, an "active subscription" includes the paid-through period after you cancel, until the end of the then-current billing cycle.
Some templates are sold as packs (marked "Pack") for a one-time payment. Packs are not included in any subscription plan, and a subscription is not required to buy or use one. After purchase, the pack stays available to download from your account while your account is in good standing. Pack usage rights are set out in the License Terms.
Payments are processed via credit cards or other methods displayed at checkout. By subscribing or buying a pack, you authorize us to charge your payment method for the applicable fees, including taxes (e.g., VAT, GST) based on your location.
Pricing is displayed in USD, with final charges reflecting local currency conversions and applicable taxes at checkout. Subscriptions auto-renew unless canceled before the renewal date. Pack purchases are charged once and never renew. Where required by law (including for certain U.S. states such as California), we will obtain affirmative consent to auto-renewal terms, provide clear cancellation instructions, send required renewal reminders (including annual reminders for yearly plans), and offer cancellation through a method as easy as the method used to subscribe.
As a courtesy, we also aim to send a renewal reminder email about 7 days before billing for applicable plans.
For international users, exchange rates and regional taxes may affect the charged amount. We are not responsible for foreign transaction fees or currency fluctuations. Pricing and taxes are clearly displayed before payment.
If a payment fails, we will notify you via email and access to templates may be suspended until payment is processed.
Refunds, cancellations, and withdrawal rights are handled as follows:
If you are a consumer in the EU/EEA, you generally have a 14-day right of withdrawal for distance contracts. For downloadable digital content, that right may end once performance begins if, at checkout, you give prior express consent to immediate supply and acknowledge that you will lose the withdrawal right, and we confirm this on a durable medium (such as email). Where those conditions are not met, your statutory withdrawal right continues to apply. Where we provide an electronic withdrawal function on the Site, EU/EEA consumers may use it to exercise applicable withdrawal rights. If you withdraw after requesting early performance of a digital service, you may owe a proportionate amount for what was provided up to withdrawal, as permitted by law.
Nothing in these Terms limits non-waivable consumer protections under the laws of Australia, Canada, the United Kingdom, or other applicable jurisdictions.
You may cancel your subscription at any time. After cancellation, your subscription remains active until the end of the current billing cycle. During that paid-through period you may continue to download and use templates under the License Terms. After the paid-through period ends, you may not use previously downloaded templates for new projects, because the license is tied to an active subscription. Videos already produced using templates during an active subscription remain fully licensed for continued use, subject to Section 9 and the License Terms. Canceling a subscription does not affect packs you have purchased.
Templates are licensed for personal and commercial use under a non-exclusive, non-transferable license, subject to an active subscription or, for packs, a completed one-time purchase. Full details are set out in our License Terms at www.motionvault.net/license, which are incorporated into these Terms by reference.
All templates and content on www.motionvault.net are owned by MOTIONVAULT or our licensors. Your subscription or pack purchase grants a license to use templates, not ownership. Unauthorized use, reproduction, or distribution is prohibited and may result in legal action.

We may suspend or terminate your account if you violate these Terms, engage in unlawful activities, or for other reasonable cause. Immediate termination may apply for severe violations (e.g., hacking).
Upon ordinary cancellation or expiration: access to download new templates ends when the active subscription ends, but end-product videos created during an active subscription remain licensed for continued use under the License Terms. Purchased packs are not affected by a subscription ending.
Upon termination for material breach: your right to use template source files ends immediately, and you must delete template source files and cease using them for new projects. Unless we notify you otherwise because of serious infringement or unlawful use, end-product videos that were lawfully created and distributed during an active subscription, or with a purchased pack, before the breach may continue to be used. We reserve all rights and remedies for breach, including damages and injunctive relief.
To the fullest extent permitted by law, MOTIONVAULT is not liable for indirect, incidental, special, punitive, or consequential damages (e.g., lost profits, data loss, business interruption) arising from your use of our services. Our total liability is limited to the amount you paid us for subscriptions and pack purchases in the prior 12 months.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where such limitation is prohibited.
Our services are provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not guarantee uninterrupted, timely, or error-free access. Your use of our website is at your own risk.
You agree to indemnify and hold harmless MOTIONVAULT and its officers, directors, employees, and agents from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your misuse of the Site or templates; (b) your violation of these Terms or the License Terms; (c) your infringement of any third-party right; or (d) content you create or distribute using our templates, except to the extent caused by our breach of these Terms.

These Terms shall be governed by the laws of India, without regard to conflict-of-law principles. Subject to the consumer protections below, courts in India shall have jurisdiction over disputes arising from these Terms.
If you access MOTIONVAULT from outside India, you are responsible for compliance with local laws regarding service use. If you are a consumer in the EU/EEA, United Kingdom, or another jurisdiction with mandatory consumer-protection or private-international-law rules, nothing in this section limits your right to bring proceedings in your local courts or to benefit from mandatory protections of your country of residence that cannot be waived by contract.
We reserve the right to modify these Terms at any time with notice via email or posting on our website. For material changes, we will provide reasonable advance notice where practicable. Continued use after changes become effective indicates acceptance of the revised Terms, except where applicable law requires a different acceptance method.
These Terms, together with the License Terms and Privacy Policy (and any order or plan details presented at checkout), constitute the entire agreement between you and MOTIONVAULT regarding the Site and services, and supersede prior or contemporaneous agreements on that subject.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, power or internet failures, or failures of third-party providers.
